Decisive Coaching, LLC
Introduction. Welcome to Decisive Coaching, LLC ("the Company"). By engaging our services, you “the client,” agree to adhere to the following terms and conditions. Please read these terms carefully before proceeding as these terms and conditions govern your relationship with the Company and coach regarding the provision of life coaching and executive coaching services; we aim to uphold transparency, professionalism, and mutual respect in all client interactions, and if you have any questions or concerns regarding these policies, please contact us for clarification before proceeding with coaching services.
1. Scope of Services. The Company offers life, executive, and strategic coaching services designed to assist clients in achieving personal and professional development goals. Our services encompass various coaching techniques, methodologies, and tools aimed at empowering individuals to make informed decisions and enhance their overall well-being.
2. Confidentiality. The Company maintains strict confidentiality regarding all client information shared during coaching sessions, except where disclosure is required by law. Clients understand that coaching sessions are confidential spaces for open and honest communication and exploration of ideas. The Client’s privacy will be respected at all times, not sold to any third party service or data providers, and not shared with an employer regardless of payment. Due to laws surrounding minors under the age of 18, Decisive Coaching, LLC does not take minors as clients; the coach may request to see a valid government I.D. before proceeding with any client, and any misrepresentation of age will be considered grounds for terminating the coach to client contract, and non-refundability.
3. Coaching is not a Substitute for Clinical Therapy or Prescribed Medication. It is important to note that the coaching services provided by Decisive Coaching, LLC are not a substitute for clinical therapy or medical treatment. While our coaches may provide guidance and support, they are not licensed therapists or medical professionals. Clients acknowledge this, and they are encouraged to seek appropriate professional assistance for issues requiring therapeutic or medical intervention, which may come at the recommendation of the coach.
4. Acknowledgment of Responsibility. By engaging our coaching services, you acknowledge that ultimate responsibility for your decisions and actions rests with you, the “client.” The Company and its coaches are facilitators in the coaching process, offering insights, perspectives, and strategies to assist you in achieving your goals, however we do not guarantee specific outcomes or results.
5. Limitation of Liability. The Company, including its coaches, affiliated, methods or models, shall not be held liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use of our coaching services. This includes, but is not limited to, financial loss, personal injury, or any other damages resulting from actions taken or decisions made based on the information provided or discussed during coaching sessions.
6. Client's Acceptance of Advice. Clients understand and accept that coaching is a collaborative process requiring active participation and engagement. While our coaches may offer advice, suggestions, or recommendations, it is ultimately up to the client to decide whether to implement such advice and to seek legal counsel before implementing any action derived from or discovered during coaching. The Company shall also not be held responsible for the client's decision to accept or reject coaching recommendations, statements, inferences, or discoveries. Clients also agree not to engage in any illegal activities during or after the coaching sessions or as a result of coaching. Decisive Coaching, LLC reserves the right to terminate the coaching relationship immediately if it becomes aware of any illegal activity on the part of the client. The Company shall not be held liable for any consequences resulting from the client's illegal actions, and the client agrees to indemnify and hold harmless Decisive Coaching, LLC and its affiliates from any claims, damages, or liabilities arising from such actions.
7. Performance and Deliverables. The Company makes no representations or warranties regarding the performance or deliverables of our coaching services. We strive to provide high-quality coaching tailored to each client's needs; however, we do not guarantee specific outcomes or results. Clients understand that individual progress may vary and are encouraged to actively engage in the coaching process to maximize their benefits, and that if they misrepresent their goals, themselves, or their narrative, the coach is not expected to fact check the client’s statements for veracity or proof.
8. Consent to Coaching. By engaging our coaching services, clients consent to participate in coaching sessions voluntarily. Clients understand that coaching involves exploration, reflection, and sometimes challenging discussions. It is the client's responsibility to promptly communicate any strategic needs, goals, concerns or discomfort with the coaching process to their coach as to tailor the experience or find a new coach.
9. Governing Law. These terms and conditions shall be governed by and construed in accordance with the laws of the state of Colorado, United States. Any disputes arising from or relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts in Denver, Colorado.
10. Amendment of Terms. The Company reserves the right to amend these terms and conditions at any time without prior notice. Any changes to these terms will be effective immediately upon posting on our website or notifying clients directly. Continued use of our coaching services constitutes acceptance of the amended terms.
11. Entire Agreement. These terms and conditions constitute the entire agreement between the client and Decisive Coaching, LLC regarding the provision of coaching services and supersede all prior agreements and understandings, whether written or oral.
12. Cancellation, No-Show, Reschedule, and Refund Policy. Life happens and sometimes gets in the way, and we understand and respect that reality. These policies are in place as a default, but each case can be handled on a case by case basis per the coach’s or Decisive Coaching Management’s discretion. Cancellation Policy:- It is the client's responsibility to ensure they attend their meetings as scheduled. Clients may cancel a scheduled meeting, but they must reschedule it to the next available time slot within 14 calendar days, as determined by the coach's schedule first, and then the client's availability. - Failure to utilize all scheduled meetings within the agreed-upon time frame (3 months or 6 months) will result in the loss of those meetings. After the time frame has expired, it is at the discretion of the coach, based on workload and availability, whether to reschedule any missed meetings beyond the original allotment of time. - If a coach needs to cancel a meeting, it will be rescheduled at the next mutually available time or added as an extension of the coaching timeline until fulfilled. Reschedule Policy:- Either party may request a rescheduled meeting with more than 24 hours' notice. The timing of the rescheduled meeting must be agreed upon by both parties.- If a rescheduled meeting is canceled by the client within 24 hours of the scheduled time, or is a no-show, it will be considered a lost meeting and billed as a full session. Technical internet and connectivity difficulties will be mitigated by traditional phone call, then email. Rescheduling is not guaranteed in case of a ‘within a 24hr cancellation or no-show.’ Refund Policy:- If a client requests a refund after ‘payment in full,’ only half the value of the remaining meetings will be refunded due to the demand of scheduling with other clients. Refunds will be calculated at a rate of $200 per remaining meeting. - In the event of a personality conflict with the client, or if the coach determines that the meetings are not productive toward the client's end goals or coach's time, meetings can be canceled at the coach's or management's discretion. Refunds for coach-canceled programs will be provided at a base rate of $200 per remaining meeting. Mediation Policy: In the event of disputes or conflicts arising from the coaching relationship, Decisive Coaching Management will serve as the mediator to facilitate resolution first, prior to legal action. In case of an unresolved issue, the offending party will pay for Mediation expenses in full, to be held at a Mediator of Decisive Coaching's choice, in Denver, Colorado within 180 days of notice. Both parties agree to cooperate fully in the mediation process, in person, and abide by the decisions made by Decisive Coaching Management and/or Mediator regarding the best course of action moving forward, at which time the offended party will cover all legal expenses and travel associated with the claim and mediation process.
13. Proprietary Methods and Conduct: Decisive Coaching, LLC utilizes trademarked and proprietary coaching methodologies, tools, and techniques. Clients agree not to record coaching sessions via video or any other means without explicit consent from the coach and Decisive Coaching Management. Furthermore, clients agree not to slander or disclose Decisive Coaching’s proprietary information, company methodologies, or its coaches or employees to third parties or social media without explicit consent from the company and the coach.
Conclusion: By engaging in coaching services with Decisive Coaching, LLC, clients acknowledge and accept the terms and expectations of performance, limits of the coaching contract, the cancellation, no-show, reschedule, and refund policy, as well as our mediation policy and proprietary methods and conduct.
